Haiwen Edward Liu Shares Practical Insights on Managing Risk Through Hong Kong Law in Zhengzhou
在 2026 年 5 月 20 日于河南郑州举行的 “ 豫港合作 扬帆全球 ” 交流会上，海问律师事务所香港办公室合伙人刘洋律师受邀发表题为 《以香港法律管理风险的实务分享 —— 从法治强优势到合作新机遇》 的主题演讲，围绕香港法律制度在企业跨境经营与风险管理中的作用分享实务观察。香港特别行政区政府投资推广署署长刘凯旋、河南省港澳办副主任孙兆敏、河南省发改委副主任陈静等出席会议。
At the “Henan-Hong Kong Collaboration, Setting Sail Globally” exchange conference held in Zhengzhou, Henan on 20 May 2026, Edward Liu, Partner of Haiwen & Partners’ Hong Kong office, was invited to deliver a keynote presentation entitled “Managing Risk Through Hong Kong Law: From the Strength of the Rule of Law to New Opportunities for Collaboration.” In his remarks, Mr. Liu shared practical observations on the role of the Hong Kong legal system in supporting cross-border business operations and risk management. The event was attended by, among others, Alpha Lau, Director-General of Investment Promotion at Invest Hong Kong, Sun Zhaomin, Deputy Director-General of the Hong Kong and Macao Affairs Office of Henan Province, and Chen Jing, Deputy Director-General of the Henan Provincial Development and Reform Commission.
本次交流会由香港特别行政区政府投资推广署、河南省人民政府港澳事务办公室、河南省发展和改革委员会及香港特别行政区政府驻武汉经济贸易办事处联合主办，聚焦豫港合作与企业国际化发展中的现实需求，探讨香港专业服务如何更好支持内地企业拓展海外市场。来自河南省及十多个地市的国有企业、民营企业等逾 320 位代表参会。
The conference was jointly organised by Invest Hong Kong, the Hong Kong and Macao Affairs Office of the People’s Government of Henan Province, the Henan Provincial Development and Reform Commission, and the Wuhan Economic and Trade Office of the Government of the Hong Kong Special Administrative Region. Focusing on practical opportunities arising from Henan-Hong Kong collaboration and the international development needs of enterprises, the conference explored how Hong Kong’s professional services can better support Mainland Chinese companies in expanding into overseas markets. More than 320 representatives from state-owned enterprises, private enterprises and other organisations across Henan Province and more than ten municipalities attended the event.
刘洋律师在演讲中指出，在全球商业环境不确定性持续上升的背景下，企业对法律服务的需求，已不再局限于争议发生后的应对，而是更加重视通过制度化安排将风险前置识别、前置分配和前置管理。香港法律体系的价值，正在于其能够以较高程度的确定性、透明度和可执行性，为跨境交易和国际经营提供稳定预期。
In his presentation, Mr. Liu noted that, against a backdrop of increasing uncertainty in the global business environment, companies’ demand for legal services is no longer confined to responding to disputes after they arise. Increasingly, businesses are looking to identify, allocate and manage risk in advance through institutional and structural arrangements. In this context, the value of the Hong Kong legal system lies in its ability to provide a high degree of certainty, transparency and enforceability for cross-border transactions and international business operations.
结合其在国际仲裁、跨境商事诉讼及复杂争议解决领域的长期实践，刘洋律师分析了香港普通法体系在合同治理、风险分配、争议解决及跨境执行方面的功能优势，并探讨了香港在 “ 一国两制 ” 框架下作为连接内地与国际商业规则的重要法律和争议解决枢纽所发挥的作用。
Drawing on his extensive experience in international arbitration, cross-border commercial litigation and other complex disputes, Mr. Liu discussed the functional strengths of Hong Kong’s common law system in contract governance, risk allocation, dispute resolution and cross-border enforcement. He also addressed Hong Kong’s role, under the “one country, two systems” framework, as an important legal and dispute resolution hub linking the Mainland and international commercial rules.
在分享中，刘洋律师还结合实务案例，介绍了香港法及香港仲裁在提升交易可预期性、优化争议解决路径以及加强资产保护方面的应用。他指出，随着内地与香港之间在仲裁裁决执行、仲裁保全协助、民商事判决互认及破产程序协作等方面的制度安排不断深化，企业在跨境经营中的风险管理工具正变得更加丰富和可操作。他表示，法律服务的价值，不仅在于争议发生后的处理，更在于通过适当的制度设计帮助企业建立稳定预期、提升风险管理能力。
Mr. Liu further illustrated, through practical examples, how Hong Kong law and Hong Kong arbitration can enhance transactional certainty, improve dispute resolution strategies and strengthen asset protection. He noted that, as institutional arrangements between the Mainland and Hong Kong continue to develop in areas including reciprocal enforcement of arbitral awards, interim measures in aid of arbitration, mutual recognition of civil and commercial judgments, and cross-border insolvency cooperation, the legal tools available to companies for managing cross-border risk are becoming increasingly robust and practical. He observed that the value of legal services lies not only in resolving disputes once they arise, but also in helping companies build stability of expectation and enhance risk management through appropriate legal and structural design.
